Our commitment

OctaHost (a brand of Sharspire Private Limited) respects copyright owners. If you (the 'Complainant') believe that your work has been copied in a way that constitutes copyright infringement by a customer receiving web hosting services from OctaHost, please provide our copyright agent with the information listed below. To be effective under the Digital Millennium Copyright Act ('DMCA'), 17 U.S.C. § 512(c)(3), your notification must include the requested information. This procedure is exclusively for notifying OctaHost that your copyrighted material has been infringed.

Filing a notice

A valid notice must include:

  • An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright interest.
  • A description of the copyrighted work that you claim has been infringed.
  • A description of where the allegedly infringing material is located on the site.
  • Your address, telephone number and e-mail address.
  • A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Upon receipt, OctaHost will follow the procedures outlined in the DMCA.

Notice & take-down

If OctaHost is notified of a credible claim of copyright infringement, or otherwise becomes aware of facts from which infringement is apparent, it will respond expeditiously by removing or disabling access to the material that is potentially infringing, pursuant to the DMCA.

Counter notification

If you receive a DMCA notification and believe in good faith that the content was removed or disabled in error, you may provide a counter-notice in writing to the designated agent above (or by emailing [email protected]) including:

  • A physical or electronic signature (type your full name).
  • Identification of the material removed and the location at which it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  • Your name, mailing address and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the Complainant.

Upon receipt of a counter-notice, OctaHost will promptly forward a copy to the Complainant and may replace the removed material or cease disabling access in not less than ten (10) and no more than fourteen (14) business days, unless OctaHost first receives notice that the Complainant has filed an action seeking a court order. Note: under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable.

Repeat infringers

Under appropriate circumstances, OctaHost may, in its discretion, terminate the accounts of customers who are repeat infringers.

Standard technical measures

It is OctaHost's policy to accommodate, and not interfere with, standard technical measures used by copyright owners to identify or protect copyrighted works, where those measures have been developed by broad consensus in an open, fair, voluntary, multi-industry process and are available on reasonable terms.
